Logajob is an internet platform whereby a homeowner/user is able to invite tradespeople to quote for work/projects which they post on the internet website. The user/homeowner is then able to compare quotes on a specified date. She/He is then able to select an offer by taking account of:
- which tradesman suits by reference to the tradespersons profile page,
- feedback and rating.
The person then completes the work requested.
Once this work is completed, each party has an opportunity to post feedback on each other.
Terms and Conditions
Access to this website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document, known as Terms and Conditions. Your registration, use of and/or access to the Logajob site constitute your agreement to the Terms and Conditions, so please read these terms and conditions carefully.
All information provided to Logajob will remain private and confidential between yourself and Logajob unless you agree to passing on your details to interested tradespeople or other. If you breach any part of these terms and conditions, Logajob reserves the right to cancel your access.
Who can use Logajob
Logajob is available to individuals and companies (or other legal entities) who can form legally binding contracts under applicable law.
Logajob reserves the right, in its sole discretion, refuse access to its site to anyone at any time and without reason.
Only legal entities and natural persons aged 18 or over with full legal capacity may register on Logajob. A legal entity can only be registered on Logajob by a natural person who is authorised to do so, their name and proof of authority must be provided to Logajob.
Logajob can terminate this agreement at any time, by notice, effective immediately.
If any member provides any information that is untrue, inaccurate, not current or incomplete, Logajob has the right to suspend or terminate your registration and/or refuse any and all current or future use of the user.
When a member gives notice of termination to the Logajob site, he agrees that jobs posted but not yet accepted at the time of termination, and Quotes received but not yet accepted, are void and no longer have any effect.
Members may not offend nor harm the rights of any third parties involved.
It is not permitted to set up more than one Members account for the same natural person or legal entity.
Tradespersons who claim to have relevant trade licenses, must send a certified true copy to Logajob Head office within 14 days. This is the responsibility of the individual and not Logajob.
Username and password
As part of the registration process you will select a unique username and password. These will allow you to gain access to the site. If any of your personal information changes you agree to notify us promptly.
All personal information we collect will remain confidential. No information will be given to a third party without your permission.
You must take reasonable care to keep your password confidential. If you should volunteer this information to anyone, they become your Nominee and are subject to these Terms and Conditions of use. We recommend you keep your Password secure and protected.
You agree to immediately notify Logajob of any unauthorised use of your password or username.
You agree that we may contact you to notify you about any information necessary for the operation and security of Logajob. You also agree that we may contact you within a reasonable timeframe after your subscription has ceased to notify you periodically about new Logajob products, services and promotions until you advise us otherwise.
It is prohibited to personally contact other members/users of the site unless permission is first obtained from Logajob. If you received a lead from the website, you are not permitted to use that lead/contact without completing the process via Logajob. We see this as illegal and are prepared to take this matter further if needs be.
All information given must be truthful and kept up to date.
Newsletters and updates
By registering with Logajob you agree to receive any newsletters and updates periodically. You can elect to remove yourself from the register by following the link at the end of your newsletter.
The Logajob site contains hyperlinks and other pointers to Internet web sites operated by third parties. These linked web sites are not under the control of Logajob, therefore Logajob are not responsible for the contents of any linked web site contained in the site. Logajob provides these links as a convenience only and the inclusion of any link does not imply any endorsement or recommendation of the linked site by Logajob. The information has not necessarily been verified on any other site either. We accept no liability for any loss caused as a result of information or opinion contained in any link found on the site.
You are solely responsible for the content of any transmissions you make to the site or any material you add to the site, including any notice board, forum, profile pictures etc. You shall not upload or distribute to or otherwise publish through Logajob any communication which:
- Is for commercial purposes or otherwise advertises or solicits for the sale of goods or services
- Is obscene, indecent, pornographic, profane, sexually explicit or abusive
- Constitutes or contains false or misleading indications of origin or statements of fact
- Slanders, defames, disparages, or otherwise violates the legal rights of any third party
- Causes injury of any kind to any person or entity
- Infringes or violates the intellectual property rights, contract rights or any other rights of any third party
- Violates any applicable laws, rules or regulations
- Contains software viruses or any other malicious code designed to interrupt destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
Logajob will make all reasonable effort to ensure that the site is available 24 hours a day, seven days a week. However, as electronic services are subject to interruption and/or breakdown, access to Logajob web site is offered on an “as is” and “as available” basis only.
We are not required to mediate in or resolve disputes between Members of Logajob however, if both parties agree, we will act as Arbitrator in any contractual dispute. Any administration fee involved in our acting as arbitrator will be paid in full by both parties concerned.
All dealings with organisations and /or individuals found on or through the Site, including payment and delivery of goods or services, and any other terms, conditions, or warranties associated with such dealings, are solely between you and such organisations and/or individuals. If there is a dispute, Logajob is under no obligation to become involved.
Payment Terms & Refunds
If you are a trade Professional, you agree to pay Logajob a success fee for any work secured through our service. The success fee is calculated as a percentage + VAT of the total value of the job, with a maximum fee of $300.00 + VAT and a minimum fee of $5.00 + VAT. Our success fee invoices have payment terms of 14 days from date of issue. Trade Professionals will be temporarily locked out of their accounts if they have outstanding balances to pay Logajob.
You, as a user of the Logajob website, understand and agree that:
Logajob makes all possible effort to ensure that this website is free from viruses and defects. However, we cannot guarantee that use of this site or any other sites accessed through this will not damage your computer. We shall not be liable for any loss or damage incurred as a result of using Logajob. We will not accept liability for any loss or damage of any kind, suffered as a result of using this website.
Disclaimer of endorsement
Reference herein to any specific commercial products, process or service by trade name trademark manufacturer of others i.e., does not necessarily constitute or imply its endorsement or recommendation. The views and opinions of authors expressed herein do not necessarily reflect those of Logajob, and shall not be used for advertising or product endorsement purposes.
You agree to indemnify and hold harmless Logajob, its directors, employees, agents, suppliers from and against any claims or demands, and liabilities including but without limitation, legal and accounting fees resulting from, or alleged to result from, your use of the Logajob website and its content.
Limitation of liability
Under no circumstances will Logajob be liable to any indirect, incidental, special and or consequential damages or loss of profits which result from any use or access of the site or content. You expressly acknowledge and agree that Logajob does not exert control over users of the site and is not liable for their opinions or behaviour including any defamatory or offensive conduct. We do not accept liability for any damage or loss caused to your computer hardware, software, internet connections or other peripherals as a result of your use of the Site.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with New Zealand law.
Nothing in these terms and conditions limits your rights under the Consumer Guarantees Act.
Copyright and Trade Marks
All material and images on the Logajob website are protected by copyright. Reproduction of material on this website is strictly forbidden without written consent from Logajob.
All trademarks displayed on the site are trademarks of Logajob or their respective owners. Nothing contained on the Site should be construed as granting any license or right to use of any trademark displayed on the Site without the express written permission of Logajob or third party owner.
Questions and Answers
In order to facilitate communication between the Homeowner and the Tradesperson, a transparent platform is available for all Quoters to view and share information. All posting on the Questions and Answers area of Logajob must relate to a job and must be factually worded.
Answers from the poster to questions raised in the Q&A area that clarify or supplement the job description become part of the job description. A Quoter remains bound by his Quote with regard to the modified description unless the quote is withdrawn. A tradesperson may withdraw a quote and requote on the altered job description.
